1. Introduction
Propelyee LLC ("Propelyee," "we," "us," or "our") respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our mobile application, web application, administrative portal, and related services (collectively, the "Services").
By accessing or using the Services, you acknowledge that you have read, understood, and agree to the practices described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not access or use the Services.
This Privacy Policy is incorporated into and made part of our Terms of Use. Capitalized terms not defined herein have the meanings given to them in the Terms of Use.
2. Information We Collect
We collect information in several ways: directly from you, from your employer automatically when you use the Services, and from third-party sources.
2.1. Information Provided by Your Agency
When your Agency creates an account for you, we receive information including: full name, email address, phone number, employee ID, job title and role, hire date, work location, department or team assignment, and other employment-related information your Agency provides.
2.2. Information You Provide Directly
When you use the Services, you may provide: profile photograph, preferred name or display name, language preferences, ratings and feedback on training content, responses to surveys or assessments, quiz and assessment answers, communications you send to us or through the Services, and any other information you choose to provide.

We use cookies, pixel tags, web beacons, and similar technologies to collect information about your interactions with the Services. This includes: Session Cookies (temporary cookies that maintain your login state and session information), Persistent Cookies (cookies that remain on your device to remember preferences and settings), Analytics Cookies (cookies that help us understand how users interact with the Services, including third-party analytics tools), and Marketing Cookies (cookies used to deliver relevant advertisements and track campaign effectiveness).
You can control cookies through your browser settings, but disabling certain cookies may affect the functionality of the Services.
2.5. Information from Third Parties
We may receive information about you from third parties, including: identity verification services, analytics providers, marketing partners, publicly available sources, and other users who provide information about you (e.g., Agency administrators).
3. How We Use Your Information
We use the information we collect for the following purposes:
3.1. Providing and Improving the Services
Creating and managing your account; delivering training content and tracking your progress; generating certificates and completion records; providing administrative tools to your Agency; personalizing your experience; responding to your inquiries and providing customer support; analyzing usage patterns to improve the Services; developing new features and functionality; conducting research and analytics; and ensuring the security and integrity of the Services.
3.2. Communications
Sending transactional messages (account activation, training assignments, reminders, compliance deadlines); sending service updates and administrative notices; sending promotional communications (with your consent or as permitted by law); and responding to your requests and inquiries.
3.3. Analytics and Product Improvement
Monitoring and analyzing usage trends and preferences; recording and analyzing user sessions to understand how users interact with the Services; identifying areas for improvement and optimization; and engaging third-party consultants and analytics providers to assist with product development.
3.4. Legal and Compliance
Complying with applicable laws, regulations, and legal processes; protecting our rights, privacy, safety, or property; enforcing our Terms of Use and other agreements; detecting, preventing, and addressing fraud, security breaches, or technical issues; and supporting your Agency's regulatory compliance requirements.
3.5. Marketing and Business Development
Contacting inactive users regarding employment opportunities or services that may be of interest; sharing information with third parties for marketing purposes as described in Section 4; and analyzing data to improve our marketing efforts.
4. How We Share Your Information
We may share your information in the following circumstances:
4.1. With Your Agency
We share information with your Agency (employer) to enable them to manage training, monitor compliance, and fulfill their obligations as your employer. This includes your training history, completion records, quiz scores, time spent on training, login activity, feedback and ratings, and other usage data.
4.2. With Service Providers
We share information with third-party service providers who perform services on our behalf, including: cloud hosting and infrastructure providers, email and communication service providers, SMS and text messaging providers, analytics and product improvement tools, payment processors, customer support platforms, professional consultants, auditors, and advisors, and security and fraud prevention services.
These service providers are contractually obligated to use your information only for the purposes of providing services to us and in accordance with this Privacy Policy.
4.3. With Third Parties for Marketing Purposes (Inactive Users)
If you have been inactive for three (3) months or more (meaning you are no longer employed by an Agency that uses our Services), we may share your personal information with third parties for marketing and recruitment purposes, including: home health agencies and healthcare employers, healthcare staffing and recruitment companies, job boards and employment platforms, and lead generation companies in the healthcare industry.
This sharing is intended to help connect you with employment opportunities in similar industries. You may opt out of this sharing as described in Section 7.
4.4. For Legal Reasons
We may disclose your information if we believe it is necessary to: comply with applicable laws, regulations, or legal processes; respond to lawful requests from government authorities, including law enforcement; protect our rights, privacy, safety, or property, or that of our users or the public; enforce our Terms of Use or other agreements; and detect, prevent, or address fraud, security issues, or technical problems.
4.5. Business Transfers
If Propelyee is involved in a merger, acquisition, sale of assets, bankruptcy, or other business transaction, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control of your personal information.
4.6. With Your Consent
We may share your information with third parties when you direct us to do so or provide your consent.
4.7. Aggregated and De-Identified Data
We may share aggregated or de-identified information that cannot reasonably be used to identify you for any purpose, including research, analytics, benchmarking, and marketing.
5. Data Retention
Propelyee retains personal information for as long as necessary to fulfill the purposes for which it was collected, to comply with legal obligations, to support our clients' regulatory compliance requirements, and to pursue our legitimate business interests.
Retention periods may vary based on the nature of the data and the context in which it was collected. Training completion records, certificates, and related compliance data may be retained indefinitely to support your Agency's regulatory and audit requirements.
Propelyee reserves the right to retain data indefinitely or delete it at any time in its sole discretion, except where retention is required by law or contract.
6. Data Security
Propelyee implements commercially reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, and destruction. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.
You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.
7. Your Choices and Rights
7.1. Account Information
You may update certain account information through the Services or by contacting your Agency administrator.
7.2. Promotional Communications
You may opt out of receiving promotional emails by following the unsubscribe instructions in those messages. You may opt out of promotional SMS messages by replying STOP to any promotional text. Even if you opt out of promotional communications, we may still send you transactional messages related to your account and training.
7.3. Location Information
You may disable precise location collection by adjusting the permissions on your mobile device. Note that disabling location services may affect certain features of the Services.
7.4. Cookies
Most web browsers are set to accept cookies by default. You can usually modify your browser settings to remove or reject cookies. Please note that removing or rejecting cookies may affect the availability and functionality of the Services.
7.5. Do Not Track Signals
Some browsers transmit "Do Not Track" (DNT) or Global Privacy Control (GPC) signals. Propelyee does not currently respond to DNT or GPC signals. As such, our data collection and use practices will remain unchanged regardless of any DNT or GPC signals received.
7.6. Opting Out of Sale of Personal Information
If you are an inactive user (not employed by an Agency using our Services for three months or more) and do not wish to have your personal information shared with third parties for marketing or recruitment purposes, you may opt out by contacting us at legal@propelyee.com with the subject line "Opt Out of Data Sharing."
7.7. State Privacy Rights
If you are a resident of a state with applicable privacy laws granting you specific rights regarding your personal information (such as California, Colorado, Connecticut, Nevada, Utah or Virginia,), you may have the right to: know what personal information we collect about you; request deletion of your personal information; opt out of the sale or sharing of your personal information; access your personal information in a portable format; correct inaccurate personal information; and not be discriminated against for exercising your privacy rights.

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, personal information about the personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this personal information would include a list of the categories of the personal information that was shared and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. To submit your request, send an email to legal@propelyee.com with the phrase "California Shine the Light" and include your mailing address, state of residence, and email address.
Please note that certain information, including training completion records, certificates, and compliance data, may be retained as reasonably necessary for your Agency's legal and regulatory obligations, notwithstanding any deletion request.
We may need to verify your identity before processing your request. If we are unable to verify your identity, we may deny your request.
8. International Data Transfers
Propelyee is based in the United States. Your information will be transferred to, stored, and processed in the United States. By using the Services, you consent to this transfer.
If you are accessing our Services from other jurisdictions, please be advised that you are transferring your personal information to us in the United States, and by using our Services, you are agreeing to that transfer and use of your personal information in accordance with this Privacy Policy.
We take steps to ensure that your information receives an adequate level of protection in the jurisdictions in which we process it.
9. Children's Privacy
The Services are not intended for individuals under the age of eighteen (18). We do not knowingly collect personal information from anyone under 18 years of age. If you are under 18, but of the required age for consent to use online services where they live (for example, 13 in the US) do not use the Services or provide any personal information to us. Any person who provides personal information through the Services represents to us that he or she is 18 years of age or older
If we become aware that we have collected personal information from a child under 18, we will take steps to delete that information. If you believe we have collected information from a child under 18, please contact us at legal@propelyee.com. If you are the parent or legal guardian of a child under 18 who has created an account on the Service or has otherwise transferred personal information to the Services, please contact please contact us at legal@propelyee.com using our contact personal information below to have that child's account terminated and personal information deleted.
10. Third-Party Links and Services
The Services may contain links to third-party websites, applications, or services, including recommendations for books, products, or other resources. This Privacy Policy does not apply to any third-party sites or services. We are not responsible for the privacy practices of any third parties, and we encourage you to review their privacy policies before providing any information to them.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we make changes, we will update the "Last Updated" date at the top of this Privacy Policy. Your continued use of the Services after any changes constitutes your acceptance of the revised Privacy Policy.
We encourage you to review this Privacy Policy periodically to stay informed about our privacy practices.
12. Governing Law
The Services are hosted in the United States and are subject to U.S. state and federal law. You agree to abide to the applicable laws of the State of Florida and U.S. federal law concerning your use of the Services and your agreements with us. If your use of the Services would be unlawful in your jurisdiction, please do not use the Services. You also agree to abide by any limitation on damages contained in our Terms of Use, or other agreement that we have with you.
